The applicant was seeking relief in a form a payment an amount of R439 434.00 for injuries caused by the employee of the respondent. The applicant boarded the train at New Brighton station, Port Elizabeth, at about 1 am the following morning, the ticket examiner wrongfully and unlawfully assaulted the applicant by intentionally pushing, kicking him out of the door of the moving train.
