Buzelwa Eunice Matinkinca and Other vs The Council of State of the Government of the Republic of Ciskei and Other. Case No: 442/93

The applicants were applying for an order to declare the Special Indemnity Decree, 1993 null, void and of no force and the first respondent to pay the costs of this application. The applicants were part of the demonstration that took place on the 7th September 1992 near the Bisho Stadium where a number of persons were shot and killed and others were injured. The Special Indemnity Decree No. 7 of 1993 was declared null, void and of no effect. The respondents were ordered to pay the costs of the applicants.

Dumisani Polycap Ngcobo vs The Minister of Defence. Case No: 20402/87

The applicant who is an adult male delivery assistant was assaulted by the four members of the South African Defence Force. As a result of the assault, the applicant sustained injuries and lost the sight of his left eye. The applicant was suing Minister of Defence for an amount of R52 540 — 00. The respondent was held liable for the injuries and ordered to pay the applicant.

Eric Songezo Magida vs The Minister of Police. Case No: Unknown

The applicant instituted an action against the respondent and claimed R 2 500 damages in respect of an alleged assault on him by members of the South African Police. The applicant was a resident of Ciskei when it was part of South Africa and when it became a sovereign and independent State, he automatically became an alien in South Africa. The question with regard to this court case was what is the position if the non —domiciled foreigner was unable to give sureties by means of a cautio fideiussoria? Zanele Victoria Buwa and Others vs The Minister of Law and Order. Case No: 4461/1992

The applicants seek relief against the respondents for damages sustained when their dwellings and contents were destroyed by fire. The applicants reside at the informal settlement at KTC Camp, Nyanga, it is alleged that the fire to have been intentionally started by members of the South African Police Force. The respondent was found to be liable for the loss suffered by the applicants and the amount of damages will be determined by the court. It includes all the documents of the case.

Alix Jean Carmichele vs Minister of Safety and Security and Other. Case No: 48/00

The applicant was seeking special leave to appeal to the court from the order of the Supreme Court of Appeal. The applicant was viciously attacked and injured by Francois Coetzee who was later arrested and sentenced to twelve and half years. The applicant instituted proceedings in the Cape High Court against the respondent for negligence. The application for special leave was granted with costs.

Rail Commuters Action Group and Others vs Transnet Ltd t/a Metrorail. Case No: CCT 56/03

This is an application for leave to appeal which rose from the question of who bears responsibility for ensuring the safety of passengers travelling on commuter trains. A train commuter was stabbed in a train and died the following day. This happened during a period when numbers of security staff on commuter trains were significantly reduced. Leave for appeal was granted.

Xolile Louis Mcilongo vs The Minister of Law and Order. Case No: 1209/88

This is an application for leave to appeal against that part of the judgment refusing interim relief pending the final determination of the matter. The applicant is a 20 year old scholar at Ekuphumelene School in Middelburg, Cape. He was taken to the police station by members of the South African Police special branch interrogated and tortured. The application was dismissed with costs.
