Phato MT

MT Phato was tried in the Barkly-East Magistrates Court on a charge of contravening the Witchcraft Suppression Act 3 of 1957 (case no 328/94). The LRC requested access to the entire police docket in the Public Prosecutor's possession. This was refused, and an urgent application was brought to the Supreme Court under the Constitution Act of South Africa 200 of 1993. It was argued that the Constitution allowed access to any information that could be used in protecting personal rights. However, the file is either incomplete or the matter was not pursued. Several files of research material are included. Amongst these are research reports from the South African Law Commission (Project 68, Access to Police Dockets, 1991) and a research report by Prof T Geldenhuys of UNISA.
