The applicants were seeking the ejectment of all members of the Magopa tribe who are presently on the farm Zwartrand, save those members of the tribe who have the written permission of the second applicant to be there. The land in question was previously owned by the Magopa tribe and now the Government of the Republic of South Africa owns it. A rule nisi was issued.
