Case 10915/1991 Supreme Court Cape of Good Hope Division (1989-1994) (19 files, 3 boxes).
In this matter the LRC represented a young man who had been shot by unknown assailants in 1988. It was assumed that the gunman had been a policeman, resulting in the LRC initially planning a civil action against the Minister of Law and Order. It was then discovered that, prior to seeking assistance from the LRC, the client had approached the Legal Aid Board, who had instructed a firm of attorneys to investigate the possibility of a claim. The Board and the firm of attorneys declined to assist the client, and allowed the matter to prescribe. As a result, the LRC instituted a civil claim for damages against the firm of attorneys. However, during the course of the matter and in 1993, the client died. The quantum then had to be revised, and the matter was settled in favour of the client's estate in the amount of R63 000-00.
