LTA hostel residents, Langa (1991-1993) (1file)

In this matter, some 136 former employees of LTA (a construction company) were threatened with eviction from the company hostel in Langa. Electricity to the hostel was cut off. The workers approached the LRC to intervene on their behalf. The negotiations resulted in a compromise in which the company allowed the hostel residents to remain, provided that they contributed to the costs of electricity. The LRC further negotiated with the Western Cape Hostel Dwellers Association (WCHDA) in an effort to get them to take over the hostel.

This item comprises one file of miscellaneous documents such as correspondence, records of electricity payments, notes on meetings, etc. It also contains a copy of WCHDA's constitution.

RACEC Group hostel residents, Nyanga

In this matter, former employees of RACEC were threatened with eviction from the company hostel in Nyanga East. The workers approached the LRC to intervene on their behalf. The negotiations resulted in a compromise in which the company allowed the hostel residents to remain, provided that they contributed to the costs of electricity. The LRC further negotiated with the Western Cape Hostel Dwellers Association (WCHDA) in an effort to get them to take over the hostel.

WJM Construction hostel residents

In this matter employees of a hostel erected by WJM Construction were threatened with eviction from the company hostel (Nobantu Hostel). The company cited excessive use of water and electricity as the basis of the eviction. The workers approached the LRC to intervene on their behalf. When the LRC threatened to defend the matter, the company backtracked, allowing the hostel to fall into a state of disrepair. The company further decided to sell the hostel. The matter was closed with the workers still occupying the hostel.

This item comprises one file of mostly correspondence between the company and the workers, and the company (or its lawyers) and the LRC, which served as instructions to counsel.

BKB Ko-op hostel residents, Hermanus (Zwelihle)

The LRC intervened on behalf of a large group of people who had taken up residence in unused hostels belonging to BHB Ko-op, a farmers' cooperative, in Hermanus (Zwelihle). The owners took steps to evict them, as they wanted to sell the hostels. The LRC indicated that it would resist the eviction if alternative accommodation was not found. The sale of the hostel then fell through, resulting in a stay of the eviction and the local authority getting involved in establishing an informal settlement to address the needs of the many homeless people in the area.

This item comprises one file of mostly correspondence between the various parties, as well as a report compiled on the needs of the homeless people in the area.

Zoyisile Wilson Ngxazana (1990)

The client resided in a hostel in Mbekweni Township outside Paarl. The Mbekweni Town Council wished to upgrade the hostel and requested the client to vacate the hostel but made no alternative arrangements regarding accommodation. Instead the Council prosecuted the client on a spurious charge of entertaining visitors in the hostel without the requisite permit. The LRC prepared for the trial, but the charges dropped.

This item comprises one file of correspondence as well as heads of arguments and statements relating to the criminal charge.

MM Nyikila vs The Town Committee of Mbekweni

Case 4360/90 Supreme Court (Cape of Good Hope) (1990) (3 files).

The client resided with her husband in a hostel in Mbekweni, Paarl. The Mbekweni Town Committee issued a notice for her eviction. An urgent Supreme Court application was brought preventing the Committee from evicting the client unless due process was followed. Thereafter the client was served an eviction notice followed by charges of being in a hostel without the requisite permit. The criminal charge was successfully defended and the Supreme Court matter was settled thereafter on the basis that the Committee not evict the client and the parties bear their own costs.
