Welverdiend Community Trust

After a long history of trying to purchase property, (assisted by the Transvaal Rural Action Committee and others), and following a spate of arrests for illegal squatting, the Welverdiend community, some 117 households, received an option to purchase portions of the farm Welverdiend in the region of Lichtenburg. The LRC was approached to assist them in setting up a Trust which could act for the community in acquiring the land, and hold the land for the community. The LRC drafted the Trust Deed as well as made representations to all the relevant authorities, such as the Receiver of Revenue, the Master of the Supreme Court, the Department of Land Affairs. The LRC also negotiated with the farmers from whom the land would be bought, and assisted with the canvassing of donors.

The client was arrested, detained and assaulted by members of the South African Police in Parys on 9 March 1992. She was also tortured (electric shocks). There had been a burglary at the client's employer's home, and she was a suspect. The police tried to get her to admit that she had allowed her boyfriend onto the premises. She was detained for five days and released without being charged. The LRC instituted a claim for damages. The matter was settled for R5000.

On 26 April 1992 the client was driving in Tembisa when he was stopped by four members of the Tembisa Municipal Police Unit. Two were drunk. They assaulted him and detained him. The LRC assisted the client in lodging a claim for damages of R20 000 that was settled for R5 000. Contains medical information.
