Sibeko, BE

The client was a labourer on the farm Rooikraal in the district Dirkiesdorp, Mpumalanga, until he was evicted in August 1998. He occupied a piece of land allocated to him by the farmer, Greyling, and planted mealies as well as raised livestock. The farmer had instructed him to go and work on another farm, Langfontein. The client requested permission to go home and look after his family before he went. The farmer insisted he leave immediately. When he did not, he was dismissed and told to leave the farm. The client believed his dismissal were not justified. The matter was referred to the Land Claims Court, and an order sought whereby the client wished to claim back his right to the land he had occupied. Numerous pre-trial conferences were held, and the matter was withdrawn after negotiations led to a settlement.

Hlatshwayo, E and another

The client was a tenant labourer on the farm Pampoenskraal in the district Dirkiesdorp, Mpumalanga, until he was evicted in October 1998. He occupied a piece of land allocated to him by the farmer, Greyling, and planted mealies as well as raised livestock. The farmer accused him and his son and brother of stealing mealies from his fields. The client refuted this saying the subsequent eviction and dismissal were not justified. The matter was referred to the Land Claims Court, and an order sought whereby the client wished to claim back his right to the land. Numerous pre-trial conferences were held, but the matter was withdrawn because the LRC and the client lost contact.

Moeti, M

The LRC assisted the client in applying for an identity document. This, however, did not reflect South African citizenship. The LRC asked the Department of Home Affairs to rectify the situation.
