This is an appeal against the dismissal and the attendant costs orders in the Land Claims Court by Moloto J of an application brought by the applicant against the respondents. The applicant is a company and owner of seven farms which have been consolidated into one farm known as the Croc Ranch in the Northern Province. The appeal was dismissed with costs, including those of two counsel.

This is an appeal to make the settlement agreement an order of court. The applicants are the black residents who were removed from Macleantown. A settlement of the claim was negotiated and an agreement was signed on behalf of the Macleantown Residents' Association, the Macleantown Ratepayers' Association and the Amatola Regional Services Council. The request to make the settlement agreement an Order of Court, was not acceded to and the matter was referred back to the Commission.

The applicants, the Ga-Mampuru which is part of the Bapedi tribe were granted the farm Brakfontein by Stephanus Grove, a representative of Paul Kruger after the Anglo-Boer War. The tribe lived on the farm until September 1973 when they were forcibly removed as part of the policy "homeland consolidation". The tribe submitted a claim for the allocation of the farm Brakfontein 187 JS.
