The case was referred to the Land Claims Court in 1997. An application in terms of Section 34 of the Restitution of Land Rights Acts was lodged. This was based on the premise that the claim to the land comprising part of the Lohathla Battle School was valid, but that it was not in the public interest that the land be restored.

In 1993 the Minister of Defence brought an application for eviction to have the remaining families in the Khosis area evicted. The application was postponed pending negotiations on the resolution of the restitution claim. However, no agreement was reached.
As part of the ongoing harassment and intimidation of the Khosis community, the school was shut down. Joseph Free, as representative of the Khosis community, challenged the Minister of Education to re-open the school.
