The LRC was approached by the Eastern Cape advisor to the Land Claims Commissioner for advice regarding a claim by a white farmer whose farm had been incorporated into a homeland. Although he had been compensated, he was not appropriated so technically his claim could be entertained and investigated. The Commissioner wanted to approach the Land Claims Court for a question of interpretation and fact on whether the farmer received fair compensation. It was opined instead that legislation be changed, which it was, meaning that the farmer had to prove that the compensation had not been fair. This matter highlighted the many uncertainties regarding policy issues around land claims.
