M Mbayi & 9 others vs. The Regional Representative, Dept. of Local Government, Housing and Agriculture, House of Delegates & others

Case 14191/91 Supreme Court (Cape of Good Hope) (1991-1992) (9 files).

The clients were the heads of 10 families who had an informal settlement in Pelican Park on land that belonged to the House of Delegates. Their dwellings were bulldozed after the Regional Representative, dept. of Local Government served notice on them in terms of the Illegal Squatting Act. A Spoliation Order was sought, but overtures of settlement were made before the matter was heard. In terms of the settlement, which the respondents insisted be kept secret, the applicants were reinstated temporarily on the same land in wooden structures paid for by the respondent. The respondent further undertook to find alternative land for the applicants.

West, I

I West was born of Coloured parents but the authorities had registered him as black in his reference book (identity document). In 1977 he lodged an objection to his classification at the Department of Internal Affairs, but this was unsuccessful. The LRC made further representations. Material includes letters from Coloured organisations and photographs.

Venter, W

A white male, Mr Wilfred Venter, applied to be re-classified as "coloured", to bypass the Immorality Act, to be able to marry a coloured women. Included are news paper articles about the case.
